1. Acceptance of Terms

By accessing or using Site Safe Hub ("the Platform"), operated by WorkDoc360 ("we", "us", "our"), you agree to be bound by these Terms of Service. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

If you do not agree to these terms, you must not access or use the Platform.

2. Description of Service

Site Safe Hub is a cloud-based construction site safety and compliance management platform. The Platform provides tools for:

• Project and site management
• Contractor and operative compliance tracking (CSCS, right-to-work, qualifications)
• Risk Assessment and Method Statement (RAMS) management
• Permits to work creation and tracking
• Site inspections and snagging
• Incident reporting and investigation
• Site entry and exit via QR code
• Drawing management with interactive work pins
• Site diary and daily briefings
• Document management and version control
• Emergency plans and drill records

3. Account Registration

To use the Platform, you must register for an account providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account
• Ensuring your account information remains up to date

We reserve the right to suspend or terminate accounts that violate these terms or that we reasonably believe have been compromised.

4. Acceptable Use

You agree to use the Platform only for lawful purposes in connection with construction site management. You must not:

• Use the Platform in any way that breaches applicable local, national, or international law or regulation
• Upload false, misleading, or fraudulent information (including falsified compliance records, CSCS details, or safety documentation)
• Attempt to gain unauthorised access to any part of the Platform or other users' data
• Introduce viruses, trojans, worms, or other malicious software
• Use the Platform to harass, threaten, or intimidate other users
• Reverse engineer, decompile, or disassemble any part of the Platform
• Share your account credentials with others or allow multiple people to use a single account
• Scrape, data-mine, or use automated tools to extract data from the Platform

5. Data Ownership

You retain ownership of all data you upload to the Platform ("Your Data"), including documents, photographs, inspection records, incident reports, and compliance information.

You grant us a limited licence to store, process, and display Your Data solely for the purpose of providing the Platform services to you. We will not access, use, or share Your Data for any purpose beyond operating the Platform, except as described in our Privacy Policy or as required by law.

Upon termination of your account, you may request an export of Your Data. We will provide this within 30 days of the request, subject to our data retention obligations under health and safety legislation.

6. Intellectual Property

The Platform, including its design, code, features, documentation, and branding, is owned by WorkDoc360 and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to use the Platform for the duration of your subscription. This licence does not include the right to:

• Modify, copy, or create derivative works based on the Platform
• Sublicence, resell, or redistribute access to the Platform
• Use our trademarks, logos, or branding without written permission

7. Subscriptions and Payment

Access to the Platform is provided on a subscription basis. Subscription plans, pricing, and features are as described on our website and may be updated from time to time.

• Subscriptions are billed monthly or annually as selected at the time of purchase
• Payment is due at the start of each billing period
• All fees are exclusive of VAT, which will be added where applicable
• We reserve the right to change pricing with 30 days' notice
• Failure to pay may result in suspension or termination of access

8. Health and Safety Disclaimer

While the Platform helps you manage safety documentation, track compliance, and maintain records, it is your responsibility to ensure that:

• All health and safety obligations under the Construction (Design and Management) Regulations 2015, the Health and Safety at Work Act 1974, and all other applicable legislation are met
• Competent persons are appointed as required by law
• Risk assessments and method statements are reviewed and approved by qualified individuals
• Site safety decisions are made by appropriately qualified personnel
• The accuracy and completeness of data entered into the Platform is verified

We do not validate, verify, or endorse the content of RAMS, permits, inspection results, or any other safety documentation uploaded to or created within the Platform.

9. Service Availability

We aim to provide a reliable and continuously available service. However, we do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to:

• Scheduled maintenance (we will provide reasonable notice where possible)
• Unplanned outages caused by factors beyond our control
• Third-party service provider issues

We will use reasonable efforts to minimise disruption and restore service promptly.

10. Limitation of Liability

To the fullest extent permitted by law:

• The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied
• We do not warrant that the Platform will be error-free, secure, or uninterrupted
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
• Our total aggregate liability for any claim arising from or relating to these terms or the Platform shall not exceed the total fees paid by you in the 12 months preceding the claim

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless WorkDoc360 and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Platform
• Your breach of these Terms of Service
• Your violation of any applicable law or regulation
• Any content or data you upload to the Platform

12. Termination

Either party may terminate the agreement:

• By you: You may cancel your subscription at any time through your account settings or by contacting us. Access continues until the end of the current billing period.
• By us: We may suspend or terminate your access immediately if you breach these terms, fail to pay fees, or if we reasonably believe your use poses a risk to other users or the Platform.

Upon termination:

• Your right to access the Platform ceases immediately
• You may request an export of Your Data within 30 days
• We will retain data as required by our data retention obligations (see our Privacy Policy)
• Sections relating to intellectual property, liability, indemnification, and governing law survive termination

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Notify registered users by email where changes are significant
• Provide at least 30 days' notice before material changes take effect

Continued use of the Platform after changes take effect constitutes acceptance of the updated terms.
